Modernization of Cosmetics Regulation Act (MoCRA): Changes to U.S. Cosmetics Laws to Support Consumer Trust in Cosmetic Ingredients

Eliminating or reducing chemicals of concern in cosmetics sold in America has been a slow process—an 84-year gap in legislative change. When compared to other countries, the U.S. has banned or restricted only nine cosmetic ingredients, compared to more than 1,600 chemicals banned or restricted by other countries or government unions, such as the European Union. In December 2022, the U.S. Congress passed the Food and Drug Omnibus Reform Act of 2022, including the Modernization of Cosmetics Regulation Act (“MoCRA”). MoCRA is the first major update to U.S. cosmetics law since 1938 and requires that a cosmetic manufacturer ensure and maintain records supporting “adequate substantiation of safety” of their cosmetic, disclose fragrance allergens, register manufacturing facilities, report adverse events to FDA, and manufacture following Good Manufacturing Practices (GMPs).

Experts from the Environmental Working Group (EWG) and the Personal Care Product Council (PCPC) will present their respective viewpoints on MoCRA particularly as it relates to provisions in the law related to the substantiation of safety. Speakers will highlight resources that cosmetics suppliers and brands can implement to comply with MoCRA to restore consumer’s trust in the safety of cosmetic ingredients as well as resources to support consumer purchasing.
